1. GENERAL OVERVIEW Welcome to Derezutskyi, your premier destination for custom jewelry design. These Terms and Conditions govern your use of our website and the purchase of our products. All fees, costs, and project scopes will be discussed with the customer prior to purchase to ensure complete transparency.
2. CUSTOM ORDERS AND PAYMENTS Because of the bespoke nature of our jewelry, the following payment terms apply to all custom designs:
• Every custom order requires a 50% down payment before production begins. This deposit secures your order and is non-refundable in the event of a cancellation.
• The remaining 50% balance is collected and must be paid in full prior to the final shipment of the jewelry.
• If any unexpected problems, delays, or required changes occur during the making process, the customer will be promptly notified.
3. PRICING AND DISCOUNTS We occasionally offer promotional pricing and discounts. Please note that any applied discounts apply exclusively to our labor costs. Discounts do not apply to the cost of materials (e.g., precious metals, gemstones, etc.).
4. SHIPPING AND DELIVERY We safely ship our jewelry domestically and internationally. Please be aware of the following policies:
• Process and delivery times may vary based on the complexity of the piece, material sourcing, and courier availability, and are subject to change.
• Any shipment costs (in-country or internationally) that exceed $20.00 USD are subject to an additional fee equivalent to 80% of the total shipping fee.
• Urgent or rush orders are subject to additional expedition fees. However, if the urgent timeline cannot be completed as agreed, these rush fees will be fully refunded to the customer.
5. RETURNS, REFUNDS, AND STORE CREDIT Due to the highly personalized nature of our craft, our return and refund policies are strictly enforced:
• Custom orders, after final approval and shipment, are strictly non-refundable.
• Only in specific situations, such as a verifiable production defect, can a piece qualify for a free repair. If the repair cannot be successfully executed, a store credit may be issued at our sole discretion.
• Any eligible returns are strictly eligible for US credit or Derezutskyi store credit only. Cash refunds are not provided.
• For all returns or items sent back for servicing, shipping must be handled at the customer’s expense.
6. REPAIRS AND LIABILITY We stand by the quality of our craftsmanship and offer repair services for our pieces. Any jewelry items in our possession for repairs are insured up to 80% based on the material type and weight of the item.
7. INTELLECTUAL PROPERTY All content on this website, including but not limited to jewelry designs, logos, text, graphics, and images, is the property of Derezutskyi and is protected by applicable intellectual property laws.
8. CHANGES TO TERMS Derezutskyi reserves the right to update or modify these Terms and Conditions at any time. Your continued use of the website following any changes constitutes your agreement to follow and be bound by the updated Terms and Conditions.
9. LEGAL AND JURISDICTIONAL PROTECTIONS
• Governing Law: These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Colorado. Any dispute arising from these terms or your purchase shall be resolved exclusively in the state or federal courts located in Colorado.
• Limitation of Liability: Derezutskyi shall not be liable for any direct, indirect, incidental, or consequential damages resulting from the use of, or inability to use, our website or products, including damages for loss of profits or intangible losses.
• Force Majeure: We are not liable for any delay or failure to fulfill our obligations if caused by events beyond our reasonable control, such as natural disasters, supply chain disruptions, or severe weather.
10. WEBSITE USAGE AND PRIVACY
• Privacy Policy Integration: Your submission of personal information through the store is governed by our Privacy Policy. By agreeing to these Terms, you acknowledge and agree to our data collection and protection practices.
• Right to Refuse Service: We reserve the right to refuse service, terminate accounts, or cancel orders at our sole discretion, particularly in cases of suspected fraud, harassment, or violation of these Terms and Conditions.
11. VISUAL REPRESENTATION DISCLAIMER
• We have made every effort to display the colors, textures, and details of our jewelry as accurately as possible. However, we cannot guarantee that your device's display will be entirely accurate. Due to the custom, handcrafted nature of our pieces, slight variations from digital representations may occur.
12. CUSTOM-MADE NATURE AND VARIATIONS Every piece of jewelry created by Derezutskyi is custom-made by hand. When ordering a piece based on an existing photograph or design, please be aware that each item is produced individually. As a result, your piece may reasonably look slightly different from the original reference image due to the artisanal nature of our production process, material characteristics, and hand-finishing techniques.
